2. Scope and acceptance of the general terms and conditions of sale

These terms and conditions of sale apply to all orders placed via the www.maisonmeoh.com website by private individuals for non-professional use only.

Maison Me Oh! products are exclusively intended for sale to end consumers, whether individuals or legal entities, to the exclusion of all resellers or intermediaries acting on behalf of resellers.

The company “maison Me Oh!” reserves the right to adapt or modify these terms and conditions of sale at any time without prior notice. In the event of modification, the general sales conditions in force on the day of the order will be applied to each order.

Any order for a product offered on the site implies consultation and express acceptance of these terms and conditions of sale, without this acceptance being conditional on a handwritten signature by the User.

In accordance with article 1369-5 of the French Civil Code, the electronic contract is validated using the “double-click” principle, whereby the online buyer can check the details of his order and its total price first, in order to correct any errors, and then confirm his order to express his acceptance.

3. Products

Products are offered for sale in the following geographical areas: Metropolitan France, Corsica (excluding French overseas departments and territories), Europe, United Kingdom, Switzerland, and abroad.

Products availability :
Our product offers and prices are valid as long as they are visible on the site, while stocks last. Most of the creations visible on the site are made in very small series or unique pieces.
Indications of product availability are shown on the product sheet. The words “out of stock” indicate that the product is no longer available.

Errors or modifications may exceptionally occur, particularly in the case of simultaneous orders of the same product by several customers. In the event of unavailability of a product after validation of the order, we will inform you by e-mail or telephone as soon as possible, offering you either to order another product presented on the site as a replacement, or to cancel your order.

maison Me Oh! accepts no liability in the event of stock shortage or unavailability of products for orders not yet accepted by maison Me Oh!

“maison Me Oh!” reserves the right to change the products offered on the site at any time and without notice.

The photographs and texts illustrating the products attempt to describe as accurately as possible the characteristics of each creation presented on the www.maisonmeoh.com website.

4. Prices

The prices of our products are indicated in Euros before tax (VAT not applicable in accordance with article 293b of the French General Tax Code), excluding shipping and handling costs.

Period of validity of the offer and price: “maison Me Oh!” reserves the right to modify its prices in the event of promotions or sales.

Products will be invoiced on the basis of the rates in force at the time the order is registered.

Products sold on the www.maisonmeoh.com website remain the property of “ maison Me Oh! ” until full payment has been received. In the event of non-payment by the Purchaser of all or part of the price of the order, “ maison Me Oh! ” reserves, until payment in full, a right of ownership over the products sold, allowing it to repossess said products by any means.

5. Payment

The Vendor will collect the full amount of the order when the order is validated.

These amounts are payable in full to “maison Me Oh!” upon confirmation of the order by credit card or via Paypal (secure online payment). To pay for his order, the Buyer has all the means of payment specified in the order form: payment by credit card via Stripe or via Paypal.

The amount due by the Buyer is the amount indicated on the order confirmation sent by e-mail by “ maison Me Oh! ” to the Buyer.

Only bank cards issued by a French financial institution are authorized.

6. Delivery

Shipping costs are fixed at 10/12 € TTC for Colissimo delivery with signature for metropolitan France depending on the weight of the order, and from 16 € TTC for Colissimo delivery with signature for Europe, the United Kingdom and Switzerland, and from 28 € TTC for the rest of the world depending on the weight of the order.

Products are shipped to the delivery address indicated by the customer at the time of ordering. Once the item has been dispatched, “maison Me Oh!” will send the Buyer the tracking number for the parcel by e-mail, together with the invoice for the order.

All validated orders are dispatched within 3 to 5 working days after the order has been registered, unless otherwise indicated on the site (Christmas, summer vacations or filming periods).

maison Me Oh!” cannot be held responsible for any delivery problems, loss or damage to packages, which would be the responsibility of La Poste.
In the event of loss or damage, an investigation will be requested from La Poste. In the event of compensation, this will be returned to the customer in the form of a credit note or refund.

The delivery times indicated correspond to the processing and delivery times of the products.

7. Right of withdrawal

In accordance with article L 121-16 of the French Consumer Code, the Buyer has a period of 14 clear days from the date of receipt to return the products ordered for reimbursement, at his or her own expense.

Products must be returned to the seller “maison Me Oh!” in new condition and fit for resale, in their original state (packaging, accessories ...),

Any product that is incomplete, damaged or whose original packaging has been damaged will not be refunded or exchanged.

The exercise of the right of withdrawal will give rise to the choice of the Purchaser:
reimbursement in cash or by cheque; this reimbursement will be made no later than 30 days following the date on which the right of withdrawal was exercised, subject to receipt by the Vendor of the returned product.

8. Reservation of ownership

The Vendor retains full and complete ownership of the products sold until full payment has been received, in principal, costs and taxes included.

During the period between delivery and transfer of ownership, the risks of loss, theft or destruction are borne by the Buyer.

Failure by the Buyer to meet its payment obligations entitles the Seller to demand the immediate return of the goods delivered at the Buyer's expense and risk.

9. Liability

The Vendor cannot be held responsible for non-performance of the contract in the event of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, particularly of postal services and means of transport and/or communications.

The Vendor cannot be held responsible for any indirect damage that may arise from the purchase of products.

The Vendor cannot be held responsible for any loss of data or files. It is the Buyer's responsibility to make all necessary backups.

The total or partial impossibility to use the products, notably due to an incompatibility of equipment, cannot engage the responsibility of the Seller nor give rise to any compensation or refund.

10. Partial invalidity

If one or more stipulations of these general terms and conditions of sale are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other stipulations will retain all their force and scope.

11. Applicable law

The sale of products by the “maison Me Oh!” company is subject to French law.

12. Information technology and civil liberties

The information collected by the Seller at the time of the Buyer's order is necessary for the management of the Buyer's order by “maison Me Oh!

In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, the Buyer has the right to access, rectify, oppose and delete data concerning him or her by contacting the Seller.

The Buyer will be informed of “maison Me Oh!” offers by e-mail. If the Buyer does not wish to receive these offers, he/she may oppose the use of his/her contact information by clicking on the icon provided for this purpose when placing the order or, subsequently, upon receipt of each prospecting e-mail sent by the Seller.
